Instead, she alleges the fast-food restaurant served her "serious illness and injury." You see, Douglas ordered delivery from a Chicago-area fast-food chain in August 2025. She claims the burger came laced with Campylobacter. That's a food-borne illness often found in poultry. Now, I won't share the gory details of her infection... but it was nasty. And so was the bill. The whole ordeal cost Douglas about $93,000 in medical expenses. Of course, her food didn't contain chicken. So Douglas claims the restaurant got sloppy... The lawsuit accuses the chain of cross-contamination. She says it didn't take the proper steps to ensure a "safe and proper" kitchen. Folks, we don't know how this lawsuit will play out. Even if Douglas gets her medical bills covered, it won't hurt this company's bottom line. But there was something about this fast-food joint that caught my attention recently. And it isn't related to cheeseburger lawsuits... This Stock Faces Stronger Headwinds Than a Contamination Lawsuit The defendant in Douglas's lawsuit is Wendy's (WEN). Wendy's stock has struggled over the past five years – plunging a massive 67%. As you may imagine, the stock spent much of that time in "bearish" territory... Now, this underperformance is understandable. Earlier this month, Wendy's reported $571 million in second-quarter revenue. That's a minor 1.7% increase year over year. The good news stops there, however... Wendy's watched its operating profit take a 24% nosedive. In addition, the company's net income declined 41%. If the financial pain wasn't enough... Burger King recently overtook Wendy's as the second-largest burger chain in the U.S. by sales. Wendy's CEO Bob Wright didn't take this loss lightly. He admitted that Wendy's had cut back on ingredient quality to reduce overhead. Also, the company relied too heavily on discounts to bring customers in. Wright outlined a five-step plan to bring Wendy's back to its former glory. Earlier this week, he announced that current Chief Marketing Officer ("CMO") Lindsay Radkoski planned to leave the company... And in her place, he hired Tariq Hassan (the former CMO of McDonald's). We'll have to wait and see if Wright's turnaround plan actually works.  However, it looks like a critical group of investors is buying into Wendy's stock. This movement leads me to believe that Wright's plan could work out... The 'Smart Money' Is Buying Into Wendy's New Turnaround Plan "Smart money" refers to the trading patterns of the biggest investors on Wall Street. This action shows up on the Power Gauge's Chaikin Money Flow indicator. And that indicator is now firmly in the green... In fact, Wendy's smart-money support is at its highest point in five years... As I said above, this means the biggest names on Wall Street take Wright's turnaround plan seriously. Ultimately, the Power Gauge still views Wendy's as a "neutral –" stock. If you're unfamiliar, that means Wendy's is a "bearish" or worse stock trading above its long-term trend line. And in the case of "neutral –" stocks, it means the long-term trend is sloping upwards. Now I don't know how much longer that line will be on an upward trend... Yesterday, we caught a glimpse of Wendy's "bearish" nature again. The stock plunged 14% in just one day. However, the recent smart-money surge means we should keep a watchful eye on the stock. But I'll still hold off on investing in Wendy's stock until I see real change – or a "bullish" Power Gauge rating.
